Intellectual Property Policy

Last updated:

This Intellectual Property Policy explains who owns the words, images and designs on hearthgift.shop, what you may do with them, what you may type into a personalized product, how we respect other people’s rights and how to raise a concern with us. Copyright notices have their own step-by-step process on our DMCA page; this page covers everything else, including trademarks, names, logos and design rights.

The short version

  • The Hearth Gift name, logo, product photos, page text and layout belong to Hearth Gift or are used with permission.
  • You are welcome to link to our pages and share products with friends. Copying our photos or descriptions to sell elsewhere is not allowed.
  • Personalization fields are for your own family names, street, dates and short phrases. We cannot print team logos, characters, brand names or other trademarks.
  • We do not take photo uploads, so we never print images supplied by customers.
  • To report a trademark, design or other rights concern, email support@hearthgift.shop with the subject “IP concern”. We reply within 24 hours on business days.

1. What belongs to Hearth Gift

Hearth Gift operates this website from 535 E Patton St, Paxton, IL 60957, US. Unless a page says otherwise, the following content is owned by Hearth Gift or used under permission from its owner, and is protected by copyright, trademark and related laws in the United States and in the countries where we ship:

  • The name “Hearth Gift”, our logo and the small flame mark that goes with it.
  • Product photographs, preview images and the live-preview artwork you see on product pages.
  • Product names as written in our catalog, product descriptions, collection introductions, help articles, policies and other written text.
  • The design and arrangement of the site, including page layouts, color choices, icons and graphics.
  • The layouts used on our signs, doormats, ornaments, coasters and keepsakes, meaning the arrangement of fonts, borders, house and key motifs and the space reserved for your text.

The tagline “For the home you’re starting, and the people you keep close” is part of how we describe ourselves, and we ask that it not be used to promote other shops.

2. Using our content: what is fine and what is not

You are welcome to

  • Browse, view and print pages for your own personal, non-commercial use, for example printing the Size Guide to take to your front door while you measure for a doormat.
  • Share a link to a product or collection by message, email or on social media so a sibling can help choose a frame color.
  • Quote a short extract from a page when you link back to it, for instance when recommending a gift in a blog post or a group chat.
  • Photograph the item you received in your own home and share that photo personally. The photo is yours.

Please do not

  • Copy, download in bulk, resell or republish our product photos, preview images or descriptions, whether on a marketplace, another website, a printed catalog or a social media shop.
  • Use our name, logo or anything confusingly similar in a way that suggests you are us, work with us or are endorsed by us.
  • Reproduce our sign, doormat or ornament layouts to make and sell your own versions.
  • Use automated tools to scrape the site. Normal search engine indexing is fine.
  • Remove or alter any copyright notice or watermark that appears on our content.

If you are unsure whether a particular use is allowed, ask first. A short email describing what you would like to do is all we need, and asking costs nothing.

3. What you can put on a personalized product

Five of our products have built-in fields: the Family Name Established Framed Sign, the Family Name Established Doormat, the First Christmas in Our New Home Ornament, the House Number & Street Coaster Set and the In Loving Memory Name & Dates Framed Sign. Those fields exist for personal details: a surname, an established year, a house number, a street name, a loved one’s name and dates. They are not a way to reproduce someone else’s protected work.

Text we cannot print

Examples of what personalization fields can and cannot carry
RequestCan we print it?Why
“THE CARTERS” with EST. 2024 on a framed signYesIt is your own family name and year.
“14B” and “MAPLE AVENUE” on the coaster setYesA house number and street name are factual details, not someone’s brand.
A loved one’s name, dates and the closing line “Always remembered”YesPersonal remembrance text chosen by you.
A sports team’s name or slogan on a doormatNoTeam names and slogans are usually registered trademarks.
A cartoon or film character’s name or catchphrase on an ornamentNoCharacters and their phrases are protected by copyright and trademark.
A company or product name, or a band name, on a signNoBrand names belong to their owners and printing them suggests a connection that does not exist.
Lyrics, poems or quotes written by someone elseNoCreative text is protected, even in short lines, unless it is clearly in the public domain.

Because we print exactly what you type and do not send a proof before production, we may not catch every problem before an item is made. If we notice an order whose text appears to use someone else’s trademark or protected words, we will email you, and we may cancel that order and refund it in full rather than print it. Our Terms of Service describe your responsibility for the text you submit.

Why we do not take photo uploads

Customers sometimes ask whether they can add a photo of a pet, a house or a team crest. We do not offer photo uploads on any product. Apart from keeping the range simple, this means we never have to judge who owns an image a customer sends. Photos you email us to show a problem with an order are used only for that purpose and are deleted 30 days after delivery.

4. Names and marks that are not ours

Hearth Gift does not sell officially licensed merchandise and does not claim any partnership with another company, team, character owner or public figure. Our product names use ordinary words such as “Home Sweet Home”, “Welcome Home”, “Our First Home” and “In Loving Memory”; we do not claim exclusive ownership of everyday phrases, only of the way we present them together with our name and designs.

If a third-party name ever appears on our site, for example a payment option shown at checkout, it belongs to its owner and its appearance does not mean that owner endorses us.

5. How we respect other people’s rights

We do not knowingly sell anything that infringes a trademark, copyright, design right or right of publicity. When we add or update a product, we avoid characters, logos, brand names and recognizable artwork belonging to others. If we learn that a product, image or line of text on our site may infringe someone’s rights, we review it and, where appropriate, change it or take it down.

The same care applies to our memorial range. Names and dates on the In Loving Memory Name & Dates Framed Sign or the Forever by Our Side Pet Memorial Framed Sign are personal details entered by the person ordering. We use them only to make and deliver that item and to answer questions about it, as explained in our Privacy Policy.

6. Reporting a trademark, design or other concern

If you own rights in a name, logo, design or other work and believe something on hearthgift.shop uses it without permission, please tell us. Email support@hearthgift.shop with the subject line “IP concern” and include:

  1. Your name, postal address, email address and your relationship to the rights owner (owner, employee, legal representative).
  2. A description of the right involved, for example a trademark registration number and country, or a description of the original design with a link or image showing it.
  3. The full URL of each product or page on our site that concerns you.
  4. A short explanation of why you believe it infringes your rights.
  5. A statement that the information in your report is accurate and that you are the rights owner or authorized to act for them.

For copyright in photos, text or artwork, please use the formal notice process on our DMCA page, which asks for a few additional statements required by law.

7. What happens after you write to us

Steps we take on an intellectual property report
StepWhat we doWhat you hear from us
AcknowledgementLog the report and the URLs listedA reply within 24 hours on business days
ReviewCompare the content with the right describedQuestions by email if something is missing
OutcomeRemove, change or keep the content, depending on what the review showsAn email explaining the decision
Follow-upCheck related products for the same issueA note if other items were affected

We may ask for more detail before deciding, especially where a name or phrase is in common everyday use. We do not share your report publicly. Knowingly false reports can cause real harm to the people named in them, so please only report content you genuinely believe infringes your rights.

8. If a product you ordered is changed or removed

Occasionally a review may lead us to change a design or take a product down. If that happens after you have placed an order, we will email you before anything ships. Where we can still send the item without the disputed element, we will tell you exactly what changes and let you decide. If you would rather not go ahead, or if we cannot fulfill the order at all, we cancel it and refund it in full to the original payment method. If you prefer, we can issue store credit instead; store credit is available on request and never expires.

An item you have already received stays yours. You never need to send back a gift because of a rights issue on our side, although the normal 60-day return described in our Returns & Exchanges policy remains available if you want it.

9. Ideas, feedback and suggestions

We enjoy hearing ideas, such as a closing line you wish the memorial sign offered or a doormat wording you would like to see. If you send us a suggestion, we may use it to improve the shop without owing payment or credit, but we will never publish your name, your order details or anything personal from your message without your permission.

10. Asking permission and getting in touch

To ask permission to use our photos or text, for example in a printed article or a gift guide, email support@hearthgift.shop and tell us what you would like to use and where it will appear. We reply within 24 hours on business days. We do not offer phone support or live chat.
